The introduction of automated vehicles promises an increase in traffic safety. Prior to its launch proof of the anticipated reduction in the sense of a positive risk balance compared with human driving performance is required from various stakeholders such as the European Union Commission, the German Ethic Commission, and the ISO TR 4804. To meet this requirement and to generate acceptance by the public and the regulatory authorities, a qualitative Risk- Benefit framework has been defined. This framework is based on (...) literature research on approaches applied in other disciplines. This report depicts the framework, adapted from the pharmaceutical sector called PROACT-URL which serves as a structured procedure to demonstrate a positive risk balance in an understandable and transparent manner. The qualitative framework needs to be turned in quantitative methods once it should be applied. Therefore, two steps of the framework are discussed in more detail: First, the definition of adequate development thresholds that are required at an early stage of the development. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 389 From the perspective of this reviewer, the presently most obvious fault in this lecture lies in Putnam's criticisms of "the coherence theorists, Ludwig, et al." (p. 97). In this criticism, it is apparently assumed that the adequacy of their proposed solution to the problem considered must be judged solely on the basis of what is presently known. Since Putnam himself acknowledges that no satisfactory interpretation (...) of quantum mechanics exists, this seems unwarranted. The superficiality of the criticism of this position makes this particularly notable. He states, for example, "to say that a wave gives an incomplete description of the state of a system is to say that systems whose state can be described by that wave function may really be in several quite different physical conditions." He then adopts the doubtful strategy of appealing to the meaning of completeness and incompleteness (they are not a matter of degree) in justification of the position that it is improper to say that a wave gives an incomplete descriptionl Despite the fact that, taken as a whole, his brief criticism of the coherence theory is somewhat ungracious. Putnam has set forth the principle issues sur~ rounding the problem with discerning lucidity. Paul K. Feyerabend, in "Problems of Empiricism," places a revisionist's version of empiricism in a carefully developed historical perspective. Empiricism as it has been known is both incomplete and weakened by undesirable assumptions. The incompleteness is to be removed by regarding empiricism as a cosmological hypothesis concerning the relation between man and the universe. The version of empiricism thus admitted has the character of a scientific theory. The undesirable assumptions are views no longer tenable of the nature and content of what is given in sense. Feyerbend understands sensations and perceptions as indicators on a par with indications of physical instruments, and likewise in need of interpretation. A philosophical method is proposed which requires theoretical pluralism instead of the theoretical monism that is (inappropriately) the ideal of much of contemporary empiricism (p. 149). The function of theoretical alternatives is to provide the means of criticizing accepted theory, to which he accords careful historical treatment. "Low level theories" are to guide us to crucial experiments, while "high level theories" are to represent the basic element of the universe. Here again the reader will find a theme which emerges erpeatedly in these lectures. This theme might be stated as follows. Both macrocosmic and microcosmic systems must ultimately be involved in scientific explanation. The crucial problem that emerges is how these two are to be related or in some degree integrated. By the way in which he develops the role of alternative theories, Feyerabend has affirmed one of the principle theoretical components of what Hegel was minded to call metaphysics. An additional observation, for which what I have said should furnish some justification: Many points made throughout this exposition (115 pp. in length) might properly be regarded as together constituting a rapprochement of empiricism and rationalism. It may very well occur to the thoughtful reader that Feyerabend, in his reconstruction of empiricism, has come very near to conceding all that a critical rationalist could ask. Other lectures included in the book are, "The Thermodynamics of Purpose," by David Hawkins, "The Physics of the Large," by Philip Morrison, and "The Ethical Dimension of Scientific Research," by Nicholas Rescher. Herbert Lionel Adolphus Hart was born in Yorkshire in 1907 to second generation Jewish immigrants. Having won a scholarship to Oxford University, he went on to become the most famous legal philosopher of the twentieth century. From 1932-40 H.L.A Hart practised as a barrister in London. He was pronounced physically unfit for military service in 1940, and was recruited by MI5, where he worked until 1945. During his time at the Bar he had continued to study philosophy and at (...) M15 his interest was further stimulated by his philosopher colleagues in M16, Stuart Hampshire and Gilbert Ryle. After the war, Hart returned to Oxford to take up a philosophy fellowship, later to become Professor of Jurisprudence. H.L.A Hart single-handedly reinvented the philosophy of law and influenced the nation's thinking in the 1960s on abortion, the legalization of homosexuality, and on capital punishment. Hart's approach to legal philosophy was at once disarmingly simple and breathtakingly ambitious, combining as it did the insights of Austin and Bentham and the new linguistic philosophy of J.L. Austin and Ludwig Wittgenstein. He sought to elucidate a concept of law which would be of relevance to all forms of law, wherever or whenever they arose: his bestselling book, The Concept of Law, has sold tens of thousands of copies worldwide. In 1941, he married Jenifer Williams (a high-ranking civil servant, later an Oxford academic) with whom he had four children. Their relationship was an enduring if unconventional one. In the early 1950s, Jenifer was rumoured to be having a long-standing affair with Isaiah Berlin, one of Hart's closest friends. She was also, falsely, accused by the Sunday Times of having been a Russian spy, an allegation which was all the more scandalous given Hart's position at MI5 during the War. Nicola Lacey draws on Hart's previously unpublished diaries and letters to reveal a complex inner life. Outwardly successful, Hart was in fact tormented by doubts about his intellectual abilities, his sexual identity and his capacity to form close relationships. Her biography also sheds fascinating light on the origins of his ideas, and assesses his overall contribution. As one of the few volumes—only two to date, actually—in the SUNY Series in Constructive Postmodern Thought to address a perennial philosophical (...) problem by drawing seriously upon both the Eastern (Zen Buddhism) and Western (American pragmatism) philosophical traditions, this book should have been reviewed in the pages of this journal a long time ago. Odin's thesis is that both traditions evidence a paradigm shift during the twentieth century from a monological and subjectivistic concept of an individualized self toward a dialogical and intersubjective concept of social self. He explores this hypothesis in the three parts of the book devoted to the social self in modern Japanese philosophy, the social self in Mead and American pragmatism, and a comparative analysis.Part 1 consists of three chapters focused on the philosophical thought of Watsuji Tetsuro (1885-1962) and Nishida Kitaro (1870-1945), and on the psychological investigations of Doi Takeo (dates not given, but whose primary works were published in the 1970s and 1980s). Watsuji's central idea is a Zen and Confucian ningenmodel of personhood whereby the self emerges in "the betweenness of person and person" as the individual (nin), understood primarily in temporal categories, and society (gen), understood primarily in the spatial categories of nature, community and family, mutually empty themselves into the other. (In a later chapter, Odin draws parallels between the yi-li—spontaneous, novel reaction-ritual action—dialectic of Confucianism and the I-me dialectic of George Herbert Mead.) This notion of self as ningen subsequently served, at least in part, the development of nihonjinron scholarship—"studies of Japanese identity"—as advanced by thinkers like Kimura Bin, Hamaguchi Eshun, and Kumon Shumpei. The goal has been to steer the middle way between individualistic (Western) and collectivistic (Confucian) conceptions of the self toward what Hamaguchi and Kumon call a contextualist (kanjin), and thereby truly Japanese, understanding.Odin's exposition of Nishida focuses on his idea of the true self—the perennial quest of the Zen tradition—as a "social self" (shakaiteki jiko) that emerges from the I-thou, self-other, and individual-environment dialectics that take "place" in the absolutely empty spatial "field" of basho.(Here, Odin suggests that rather than drawing from Martin Buber's philosophy, both Nishida and Buber drew common inspiration from Ludwig Feuerbach's Principles of the Philosophy of the Future [Grundsatze der Philosophie der Zukunft, 1843]). The true self is therefore the no-self in the locus of absolute Nothingness. As such, the true self is also the empty self. This leads to the true self conceptualized as the intersubjective self. The present volume has been compiled from notes taken down at the time by three of the students: Rush Rhees, Yorick Smythies, and James Taylor. They have been supplemented by notes of conversations on Freud (to whom reference was made in the course on aesthetics) between Wittgenstein and Rush Rhees, and by notes of some lectures on religious belief. As very little (...) is known of Wittgenstein's views on these subjects from his published works, these notes should be of considerable interest to students of contemporary philosophy. Kilby cites McCabe on only a handful of occasions, but, more so than the references, the form and the (...) content of Kilby's volume bring McCabe to mind. Like McCabe's book, God, Evil and the Limits of Theology consists of mostly short and readable but highly provocative essays, notwithstanding that Kilby's essays are more academic in form and hang together thematically better than McCabe's text. Regarding content, it is clear that Kilby is aligning herself in certain respects with the tradition of grammatical Thomism that McCabe helped initiate, though it might be better to consider Kilby's work an exercise in "grammatical apophaticism," since Thomas figures prominently in only three of the eleven essays. Even the "grammatical" attribution should be applied with caution, though Kilby does use the term herself, because Ludwig Wittgenstein, whose influence puts the "grammatical" in grammatical Thomism, is not at all explicitly drawn upon for theological purposes. Nevertheless, as will become clear through our discussion of the essays in particular, the arguments and themes of the collection build upon and assist in providing a valuable expansion of the line of thinking carried on by grammatical Thomists.The first four essays treat various concerns in Trinitarian theology, and the first, entitled "Perichoresis and Projection: Problems with Social Doctrines of the Trinity," does some important preliminary critical work before Kilby makes her own constructive contribution to Trinitarian theology. For Kilby, social Trinitarianism (Jurgen Moltmann, Colin Gunton, and Patricia Wilson-Kastner are some proponents with whom she engages) is characterized by the idea that the Trinity, conceived as the interpenetration or perichoresis of three persons ("person" applied with fairly minimal negation), should be understood more as a rich source of [End Page 733] insight for apprehending the proper nature of human sociality than as a fundamentally mysterious doctrine. As the title of the chapter suggests, Kilby's primary critique of social theories of the Trinity is that they entail projection of human experience and reality into the Godhead, and she takes this critique a step further in arguing that it is of the very nature of social theories of the Trinity that they do just that. Her defense consists of a key claim that recurs throughout the rest of the Trinitarian essays—that human beings cannot know what it means for God to be three persons but one God. Consequently, social Trinitarians' bold descriptions of insights pertaining to how the three persons are united in perichoresis could be only a product of projection. Kilby concludes this essay by gesturing toward her constructive alternative to social theories of the Trinity: the doctrine of the Trinity does not give insight into God; rather, it determines the grammar for the structure of Christianity.Kilby follows up her first chapter with a study of Thomas Aquinas's Trinitarian theology, and as might be suggested by the conclusion of her first essay, she offers a thoroughly apophatic interpretation of Thomas, very much in the vein of David Burrell's Aquinas: God and Action. That is, Kilby claims that Thomas is not giving us insight into God but only manifesting the limits of our God-talk. Kilby is critical of various contemporary retrievals of Thomas that attempt to show some sort of "making sense" in Thomas's Trinitarian theology, and she focuses her argument regarding what might be called its "nonsense" on Thomas's uses of the terms "procession" and "relation." Kilby claims these terms appear to lose all intelligible connection to human experience when applied to the Trinity, especially noting the tension between, on the one hand, the subsisting relations being identical to the divine essence and, on the other, their being really distinct from each other. BackgroundThe transplantation of porcine islet cells provides a new potential therapy to treat patients with type 1 diabetes mellitus (T1DM). Compared to other biomedical technologies, xenotransplantation stands out in terms of its involvement of animals as graft sources, as well as the possible transmission of infectious diseases. As these aspects are especially relevant for potential xenotransplantation recipients, it is important to assess their opinion regarding this technology, in particular in terms of the requirements that should be met in the informed (...) consent process for xenotransplantation.MethodsWe conducted qualitative interviews with seven T1DM patients to assess their information needs prior to xenotransplantation. Before the interview, the participants received a model informed consent form for a clinical trial with porcine islet cells transplantation. The interviews were transcribed and analysed using qualitative content analysis.ResultsIn the interviews, we identified several requirements that are crucial for patients with T1DM in order to consider xenotransplantation as a potential treatment option: therapy-related requirements, professional care and supervision, successful behaviour and attitude management, improving quality of life, and managing control/self-determination challenges. Regarding the informed consent form, several of the participants’ questions remained open and should be addressed in more detail. The interviewees stressed the importance of personal consultations.ConclusionsTo become a sustainable therapeutic option, patients especially expected an improved diabetes control and a reduction of diabetes-related burdens. Health-related aspects prove to be pivotal for diabetic patients when considering porcine islet cell transplantation. The use of pigs as source for organ retrievals was not considered as problematic. Though almost forgotten today, Herbert Spencer ranks as one of the foremost individualist philosophers. His influence in the latter half of the nineteenth century was immense. Spencer's name is usually linked with Darwin's, for it was he who penned the phrase: survival of the fittest. Today in America he is most often admired for his trenchant essays in 'The Man Versus the State'. But Spencer himself considered THE PRINCIPLES OF ETHICS to be his finest work. In the second volume, (...) under 'Justice', is his final statement on the role of the state. _Essays on Wittgenstein and Austrian Philosophy_ is presented for the 60th birthday of professor Christoph Nyíri. The essays presented here for the first time are focused on Austrian intellectual history, and on Wittgenstein’s philosophy – the two main areas of Professor Nyíri’s interests. Typically, the contributors are outstanding scholars of the field, including among others David Bloor, Lee Congdon, Newton Garver, Wilhelm Lütterfields, Joachim Schulte, Barry Smith. The volume is of primary interest for Wittgenstein scholars and those studying the 19th (...) and 20th century Austrian intellectual history. As the volume is presented for Professor Nyíri, the papers collected here reflect his interests in Wittgenstein and Austrian philosophy. Beginning with an introductory chapter on Nyiri’s achievements in this field of scholarship, the volume is in four parts. The first part contains essays on Austrian philosophy broadly understood, more precisely on its socio-historical context (Barry Smith and Wolfgang Grassl), on the relation between Marxism and Arnold Hauser’s philosophy and sociology of art (Lee Congdon), and Neurath’s connection to naturalistic epistemologies (Thomas Uebel). The second part presents Wittgenstein's philosophy in context. Jaakko Hintikka’s paper argues that Wittgenstein’s probable dyslexia can be seen as an external influence on and a source of his philosophy. David Bloor discusses Wittgenstein’s philosophy in the context of Edmund Burke’s conservatism, which can be read as a background of Nyiri’s influential interpretation of Wittgenstein as a conservative philosopher. Newton Garver also touches on the problem of conservatism while discussing passages of _On Certainty_ in the context of Kant, Moore, and T.S. Eliot. Klaus Puhl’s essay connects Wittgenstein’s remarks on rule-following to Freud’s concept of retroactivity, and argues that rules emerging from empirical regularities can be seen as retroactive constructions. The papers in the third part of the volume offer close readings of Wittgenstein’s works. Rudolf Lüthe offers two readings of Wittgenstein’s criticism of philosophy in the _Tractatus_ can be read in two ways with different consequences, among them is the appearance of philosophy inspired by art rather than the sciences. Joachim Schulte offers an interpretation of Wittgenstein’s use of ’natural history’ that can accommodate all of his remarks containing this concept. Herbert Hrachovec discusses the relation of pictorial and linguistic representations in Wittgenstein’s _Nachlass, _arguing that there is no pronounced opposition between the two. The forth part of the book, containing three papers in German, continues the close inspection of Wittgenstein’s later works. Wilhelm Lütterfelds reconstructs Wittgenstein’s philosophy of time as pointing out memory being the very source of time. Katalin Neumer inspects Wittgenstein’s frequent references to photographs in the context of aspect-seeing and compares them with other remarks on theatre, painting, and music. She concludes that there are no philosophically important structural differences between them. Peter Keicher’s paper offers a comprehensive view on Wittgenstein’s prefaces in the context of his various book-projects. The volume ends with a select bibliography of Professor Nyiri’s works. Physical activity, specifically exercising, has been suggested to improve body image, mental health, and well-being. With respect to body image, previous findings highlight a general benefit of exercise. This study investigates whether the relationship between exercising and body image varies with the type of exercise that individuals preferentially and regularly engage in. In addition, physical efficacy was explored as a potential psychological mediator between type of exercise and body image. Using a cross-sectional design, healthy regular exercise practitioners of yoga, ballroom (...) dance, team sports, or individual sports as well as healthy adults reporting no regular exercising were surveyed. Body image and its different facets were assessed by a set of standardized self-report questionnaires, covering perceptual, cognitive, and affective body image dimensions particularly related to negative body image. In addition, participants were questioned with regard to mental health. Participants were 270 healthy adults. Descriptive statistics, measures of variance, and multiple linear regression analysis with orthogonal contrasts were performed to investigate differences between the different exercise and non-exercise groups in the variables of interest. In line with the hypotheses and previous findings, the statistic comparisons revealed that body dissatisfaction was most pronounced in the non-exercise group compared to all exercise groups [contrast: no exercise versus exercise ]. Physical efficacy, as assessed with a standardized questionnaire, mediated the difference between type of exercise and body image including perceptual, cognitive, and affective body image dimensions. The findings shed light on so far less systematically investigated questions regarding the relationship between types of exercise, like yoga and ballroom dance, and body image. The results underscore the relevance of considering possible influencing factors in exercise research, such as the perception of one’s physical efficacy as a mediator of this relationship. (shrink)

The root of any system of economic theory is the theory of price. But while modern Austrian economists have put a great deal of effort and ingenuity into building up the superstructure of their discipline since the mid-1970s, they have paid scant attention to ensuring that the price theory supporting the edifice is a sound and settled doctrine. The result is that, for many current Austrians, price theory is a “dynamic” version of neoclassical price theory. More precisely, it is Chicago (...) price theory with a theory of entrepreneurship and of competition as a rivalrous process grafted onto it. This ad hoc approach to Austrian price theory thus relies heavily on the analytical tools and techniques developed by Alfred Marshall, Frank Knight, and Jacob Viner. George Stigler later elaborated these individual contributions into a systematic price theory.The prevailing approach almost completely ignores the fact that there exists an alternative “causal-realist” tradition of price theory that was founded by Carl Menger and developed by his followers both in Austria and abroad. These include especially Böhm-Bawerk, J.B. Clark, Frank Fetter, Herbert Davenport, Philip Wicksteed, and Ludwig von Mises. The causal-realist tradition, which is explicitly anti-Marshallian and anti-Stiglerian, maintained a shadowy presence in Austrian economics for most of the postwar period. It is only in recent years that some Austrian economists, seeking a sound price theory to sure up the foundations of their discipline, have explicitly recognized and embraced it.Israel M. Kirzner’s neglected book, Market Theory and the Price System, which was first published in 1963 and reprinted in a new edition this year, was the first and only systematic attempt to marry Stiglerian price theory with elements of the causal-realist tradition. Murray N. Rothbard, who had already reformulated and significantly advanced the causal-realist tradition in his own treatise Man, Economy, and State, wrote a comprehensive and quite critical referee report on Kirzner’s book manuscript for the publisher in 1961. His comments have never been published before.This article contains two parts. The first part is a response to certain claims and omissions made by Peter J. Boettke and Frédéric Sautet, the editors of the new edition of Kirzner’s book. The second part contains Rothbard’s report on the book as a supporting document for the arguments of the first part. By proceeding in this way the goal is to clarify the important issues at stake for Austrian price theory. (shrink)

The rapid development of CRISPR-based gene editing has been accompanied by a polarized governance debate about the status of CRISPR-edited crops as genetically modified organisms. This article argues that the polarization around the governance of gene editing partly reflects a failure of public engagement with the current state of research in genomics and postgenomics. CRISPR-based gene-editing technology has become embedded in a narrow narrative about the ease and precision of the technique that presents the gene as a stable object under (...) technological control. By tracing the considerably destabilized scientific understanding of the gene in genomics and postgenomics, this article highlights that this publicly mediated ontology strategically avoids positioning the “ease of CRISPR-based editing” in the wider context of the “complexity of the gene.” While this strategic narrowness of CRISPR narratives aims to create public support for gene-editing technologies, we argue that it stands in the way of socially desirable anticipatory governance and open public dialogue about societal promises and the unintended consequences of gene editing. In addressing the polarization surrounding CRISPR-based editing technology, the article emphasizes the need for engagement with the complex state of postgenomic science that avoids strategic simplifications of the scientific literature in promoting or opposing the commercial use of the gene-editing technology.
